Basically ... if a merchant/business wants to just say F-off .. they can. He doesn't care what the BBB or anyone thinks of him .. he just wants his money ... and he got it. It cost me three times as much to fix what they did wrong, and cost me all that time and effort to complain and try to get it resolved.

I am not sure what credit card you are using. But I purchased online with companies that are out of state, and I never had a problem with charge back. I heard of people doing charge back with companies that are out of state, they never had problems.

Btw, you should file complaints to California Attorney General because the business is in CA, not NY.

Usually, you are not the first victim of a bad business. The more unresolved complaints in this company's record in BBB, they will have a harder time to argue with charge back. If Attorney General receives enough complaints, they will start investigate. Have you tried sending to the media, like Dateline NBC, NBC news station, 20/20, CBS news station...? Have you seen bad small business owners got tricked by hidden camera and chased by a bunch of reporters and interviewers on TV? And how funny those owners look on TV? I bet they got nightmare for several months.

No, none of your effort was wasted. Any future victim of that bad business will have a much easier time to do charge back just because of your complaints in BBB because I was told that credit card company refer to the company's record in BBB for charge back. They will be investigated by Attorney General because there is one more complaint against this bad business. And those owners will always worry whether their next customer is a undercover reporter or not.

It was a Citibank Platinum Mastercard. I cancelled it after they gave me that excuse.

It *is* a fact though .. on the back of your credit-card statement there is a clause that we all agree to, stating purchases made outside 100 miles or your 'home state' (whichever comes first) are not required to be covered.

They CAN cover them if they feel like it .. but it is an easy loophole for them to refuse to help.

I went to the BBB site to check on the company, and see if my complaint is up there. It isn't. The BBB concluded my complaint was "completed successfully" or whatever, and it doesn't show the negative I was hoping for on there. The company claimed I'm totally unreasable .. blah blah .. blah .. ect

I can look into complaining with the CA Attorney General, but from what I've seen .. I've lost.

kirbydog said:You can write about good, bad and otherwise via Planet Feedback. I have received a fair amount of replies this way.
I've had pretty good luck with PF as well, including one case where buy.com was giving me the runaround on a PM request, continuously pushing out the date when it would be processed. When I submitted a PlanetFeedback complaint, I got action within 24 hours. A co-worker has a problem with the memory card they recently cancelled the orders on, he called back and they reordered it for him and said they would put in the PM request after it shipped, then they said it would be submitted automatically after he received it, and it's now been a few weeks and still no PM. He finally disputed the charge with his credit card on Friday. I told him from day one to just go complain via PF and it would be taken care of.

On the other hand, I complained about J&R and had my PF complaint handled by the same guy in customer service that I had been dealing with previously. Ugh.

For rebates that are sitting unpaid at rebate companies like CPG and TCA, if you believe that the problem is that the company who funded the rebate is not paying, and that is the reason for the delay, you might try poking around their website for an email address you can send to, and send a note asking if you will be getting your rebate soon, or if you need to look into reporting them to government/consumer authorities for rebate fraud. I did this twice recently, once with Vivendi Universal, where I got some action (although they continued to deny it was their problem, even though I knew from the company processing the rebate that it was), and once with Riverdeep, where my results are still inconclusive (they told me once my rebate has been processed by the rebate house and is waiting to be paid, it is out of their hands; I told them that was not true and was an unacceptable response).

I contacted State Department of Justice for the Circuit City Western Digital December $40 rebate after trying BBB without any solution. CircuitCity legal department responsed and issued me a $40 gift card. I got to contact CC legal department directly after 3 weeks of waiting for the gift card. Finally they mailed the card to me.
It looks like those companies will pay only when they have no alternatives. You have to fight.

Thanks for a great thread!

Recently my sister made a purchase at Arden B online (whatever clothing store that is). The item she recived was actually defective and she sent it back. 3 weeks later, there were no refound issued on her credit card, she called and was told a credit issue request has been sent and it could take up to 2 credit card billing cycles. She called again after another 3 weeks and got the same response. Another 2 weeks later, same thing. I told her to file a compliant with BBB online and she did. 2 days later, problem solved. They called her and told her they'll issue a new credit request and she got it 3 days later in her online account statement.

THANK YOU THANK YOU you have saved me hours of searching. I have been waiting since March for a BenQ rebate. I threatened to complain to all those agencies, but had difficulty finding the exact one to write to. Thanks so much. A Great thread.

Excellent post, TheDealMaker! This will definitely help in getting back those rebates that companies so often deny paying out for one reason or another.

Thanks to the OP, I sent a letter to the FTC. I received a reply. They said that under Section 5 of the FTC Act the companies that do not pay out rebates are engaging in deceptive or unfair practice. They do not handle individual cases, but do intercede if they see a pattern emerge. Just thought I'd share and thanks again for this post. What a life saver.
