The store is also liable - its called "the implied warranty of merchantability." If you're thinking that is legalise, it is.

If you really wanna take it to the mat, do some internet research and then take 'em to small claims. It will cost around $100 to file, depending on your jurisdiction. In most places, neither side can take a lawyer, so it is likely that they'll just call you and want to settle - otherwise they have to send someone to represent them. In general, small claims judges are plaintiff friendly IIIIIIFFFFF you've done your homework, show up in a suit, call them sir/your honor/judge, and have copies of all your paperwork made and labeled for them to look at.
