Difference here to the susposedly unintentional price mistakes retailers make to get folks in and then switch is it's been brought to their attention- they say it's "wrong", but they're going to publish it anyway. Definition of intentional fraud is knowing something is invalid and offering it anyway. Hope some states nail em on this- it's taking bait and switch to new levels.Ads are not offers to sell, they are invitations to come in and bid. Everyone needs to take a class in contract law and become an informed consumer. Even if this was an offer, they have rescinded it before it even became effective, and they have the right to do that. BB might be a crappy company that sells $25 USB cables to 80 year old ladies, but they're not doing anything illegal yet, and that's why we hate them. Oh, but BB have done very fraudulent things. How can we forget, "A tale of two web sites". |

I agree that everyone needs to take contract law classes, especially business owners. I think it should be required to get a reseller license to pass a contract law test. In pure simple contract law, an advertisement is an offer to sell. An offer, can at any time be revoked before acceptance. An offer is not a contract until acceptance. Recinding the advertisment is within their legal rights. In practice, an advertisement isnt an offer. In practice, it is an invitation to treat and not necessarily a firm offer. Your point is a gray area of the law and can be fought in court. It may go either way. Anyways, to protect consumers, we have other laws that have to do with advertising. Bait and Switch, false advertising, fraud... As far as them recinding the offer... Most people dont read Fatwallet.com. If the offer is not recinded in the advertisement, then it will attract ignorant people to the store. The false advertisement will bring in unsuspecting customers. By the time these consumers find out it was a price mistake, they will be inside the store with tons of offers for other stuff. They got people into the store with their "deception". These people will take precious time out of their day to drive to the store. They will spend money on gasoline for their car to get to the store. The store doesnt care as long as it can trick people to come in. Once at the store, they will find that they wasted their time and gas. |

On another note..I read this post at lunchtime while I was next door to Bestbuy. I went in and ordered 10 notebooks for my "business" complete with all accessories and service plan and also ordered 2 of the 50" Panasonic plasmas (one for my living room and bedroom) complete with service plans, backup power supplies and all necessary $100 overpriced cables (I told them I needed 3 of there longest HDMI cables and sets of component cables for each TV). I told them I would wait at the front of the store while they were finishing up processing my orders. It took like 10 best buy employees (including 2 store managers) 45 minutes to get everything together and ring it all up and bring the televions to the front of the store- the sales manager was literally salivating while the cashier brought up the total. I whipped out my credit card but pulled it back and simply told them I changed my mind and would buy everything at Circuit City and walked out. LOL- payback is a bi*** |

However, these guys keep doing it, don't you think by now it would have been cheaper just to get an intern or two at HQ to look over it one last time? You know... just refrence the prices? Oh wait, this is best buy we're talking about. How much do you think they would lose if they honored the 50" (in stock sales only) vs honoring 100 bucks for EVERY customer (including rainchecks)? Deceptive at it's finest. |
