Every jurisdiction has different laws on false advertising. Under contract common law they are about to make an offer, couched in tons of fine print, they will not honor, and seem to be making no effort to stop it's publication. |

Agree about different laws in different jurisdiction but can you give us just one example? For someone that has over 25 yrs of law practice, surely naming one law should not be an issue. |

Its an instant rebate over and above any regular price or sale price item they have. I myself am interested in several plasmas. Best Buy actually has better prices on most of them than I have found researching other places such as Circuit City, Fry's, etc...so what are they doing wrong in your opinion? I have no problem supporting such a good retailer offering a wealth of choice at fair prices. Do you ever go into a Best Buy and see the expenditure they put out just in running juice to over 200-300 flat panels and other sets on display? I know I appreciate it when I have a chance to go in there and compare what I want. I have no unrealistic expectations of them matching prices with a BuyDig.com, etc...of course I don't expect that and I don't mind paying a little extra to a place that has a good return policy as does Best Buy. I can buy a plasma there and in 30 days bring it back with no problems. NOW- that doesn't always mean that I don't still purchase online, I do about half the time. |

Nevermind the fact you have to wait AT LEAST 1 hr in line to return the said TV. They always understaff the customer service desk... I NEVER have to wait that long - maybe 10 minutes tops? This is what I am talkign about. I see these wild claims in this forum all the time and I scratch my head. Now I will say- you have to be insane to buy ANY extended warranty from Best Buy. But that goes for any retailer, not just Best Buy. And yes, of course, don't buy your cabling from them (and again, Circuit City, et. al., have same insane markups on that stuff). |

None...is it so shocking to have someone in this forum who doesn't think Best Buy is bullocks?
Actually, it is. A few years ago, BB actually had some decent deals from time to time, and not-so-horrible customer service. Most people on this forum may remember those days, and most will also agree those days are long over. |

Update: Told you it would be made up. Sorry- just back from taking my neighbor to get one of the $350 tv stands at BB clearanced down to $19.99 and getting a price match on one I bought Wednesday. I guess BM4Life and JimEmpty think that the forum wants a through discourse on false advertising laws so here goes: "Bait and Switch" sections of state false advertising laws are there to stop retailers from advertising a product and price they know will not be there or will turn out to be of such low quantity that few will get it or of such inferior quality that they can be switched to another more expensive product. This is why you often see "at least ten at each store" etc in ads- so that the advertiser is protected against bait and switch charges. These laws protect not only the public but also retailers who refuse to participate in such practices. For example, in New York, California, and other states with strict bait and switch regulations the fact that an advertiser plans in advance of releasing an ad that the price will not be honored is exactly what an advertiser has to be found guilty of to be fined. Ordinarily the defense is that the advertiser made every effort to withdraw the ad as soon as it learned of the "mistake." But BB here is saying that it knows in advance that an ad it will put out is false. The question is how far in advance did BB know it's front page ad was false? If it had been a small ad on an inside page it would be more likely it was something that just slipped through. Obviously BB knows it's in hot water this time because I just got an email as a regular customer announcing the "mistake", I've never gotten one before,ever. I'm sure BB will be able to show that it just realized it's front page offer was false just this evening, just before the first Saturday supplements are delivered and did everything possible to notify as many people as possible without using one of their 100-a-day television ads. I certainly hope they can because in strict protection states regulatory bodies are much more of a problem to them than breach of contract lawsuits. Their exculpatory fine print will save them in many lax states from small claims suits over contract. In others customers who did not get the advance retraction and who go to a BB and get refused will get damages and possibly performance, especially if BB admits it knew in advance the ad was false. I'm sure here in DC and in Maryland small claims courts will elbow BB to compromise with plaintiffs and work out a deal. In Virginia corps rule the roost and BB will have it easier. Which brings us to the real issue- the fact that losses in other state small claims courts have probably already been factored in. Corporations from tobacco to pharm to retailers make their decisions in the new order based not on whether something is right or wrong but how much it will expose to liabilty versus how much additional profit will be made. In reality a corporation has figured a month ago that liabilty and fines will total below x amount and additional profits from the million or so extra customers coming for the false offer will total 1000 times x amount. Like Tony Soprano says- it's just business. You do the crime you do the time or pay the fine and if the penalty is a lot less than the profit yes, you do the deed. American business morals 2007. But state regulators and licensing are a little scarier and make nervous ones at the last minute try to cut their exposure. Again, I'm sure BB just learned of the false ad this evening. I shop BB and CC a lot and am sure they wouldn't just follow business motives. Although I try to buy from Amazon as much as possible now because of their stellar customer service, I used to really like BB years ago for theirs. Anyway, just in for a few minutes so I thought I'd fulfill the dynamic duo's request. My preference for boneheads usually runs to fish dishes. |

[/Q said: I agree, well said. This is corporate morality or shall we say amorality, their bottom line is profit and answering to their shareholders. But I do not agree Best Buy purposely placed a false ad for the sole purpose of their bottom line (and I think you would agree with me and did state that in your post). The Plasma TV in question was priced much lower but that is a subtle nuance probably lost on majority of consumers to whom this deal would not necessarily JUMP out causing a stampede to the BB stores. One would have to be up on Plasmas and the different model numbers as Panasonic has another Plasma cose to this one with a different model number that runs about the same price anyway. What I am saying is that this is not like advertising a laptop for $199.99 or say a 50 Inch Panasonic Plasma for 1299.99 - the deal is only recognized as a DEAL to those who know the generic product line-up and have done some research, certainly not the mass market. |

wow this is a new form of FADVERTISING (false advertising). bait n switch folks to get them in store, and email folks a rebate while they price-jack their items for a week. If they can pull this off, kudos to them. I still have my 1.5 year old $1499 Westy LVM42 1080p monitor with $149 4 year warranty. Free ship. Good deal. Waiting for the LVM47 to go clearance since its now EOL sort-of. Then i can move the 42 to the bedroom for some 1080p pr0n.
lol. bestbuy is cool sometimes, this isn't cool. They should just give us a 10% unrestricted discount lol. |

My Maxent 50" plasma, which is 2 years old now, is under the BB 4-year "everything's covered" warranty. Even power surge/electrical damage is covered, which IIRC, BB dropped. Since I bought the warranty when it was still in effect, though, they have to cover it. I can guarantee you that at 3 years 6 months, I'm gonna have a power surge that damages it, and I get the full purchase price (around $2400) to apply to a new unit. I;m hoping the 50" or larger LCDs have dropped in price and increased enough in quality to cover it. The Maxent does 720p natively and 1080i quite nicely, and it's all I need. Still, I'm tempted to try to get some other store to PM the BB ad...not that I "need" it or anything... |
