Mr Knowledge, where did you get this knowledge? I can't think of any reason why a buyer would make this assumption and post it to mislead others. If you know the Fuze inside and out like you said, you should already know this won't happen. |

well nor will asking for a "credit" on your credit card. i doubt very much Shnoop or any business would essentially give a working product away. even if they did make a mistake also thats not an assumption. its a suggestion and an opinion Newegg gave me a 1 year replacement warranty with my refurb Fuze independent of Sandisk or the refurb company (Xtremeupgrades). so its not like its unheard of. and it would ease the concerns of some, who feel they may have gotten an inferior product and if people are still concerned....come visit us at the anythingbutipod message board in the Sansa Fuze forums. some good posters there with lots of info and knowledge about the Fuze. need a fix, firmware question, Rockbox install instructions.... want to mod the player? you can find out how there. Sandisk also has forums for that stuff the Fuze can be a dynamic little player. folks should enjoy it, refurb or not. and $30 is still pretty cheap. and normal refurb price. so don't worry....be happy you can do this to V.1 Fuze's now: http://www.youtube.com/watch?v=Y-3HNqvjt1o its easy with the test build of Rockbox and will be getting super easy soon with the final version. it voids the warranty but hey...you only get 90 days anyway! lol nah its safe and very cool |

I don't want it for free, but the product is not worth what I paid for it, believing it was new. It will cost Shnoop to have it shipped back, repackaged, resold...and I'm sure they'll be getting some compensation from their supplier. I'm just saying they should make a pragmatic decision and credit $10 back to everybody, which would turn me from displeased into a satisfied customer. Thank you for getting back to us. At this time, the only redress we can offer you is to send it back at our expense for a full, unconditional refund. Alternatively, we can offer you a 20% partial refund in the form of a store credit in lieu of sending the MP3 player back. This would be in accordance with all local, state and Federal trade laws, as well as our merchant agreement with the credit card companies. Please confirm whether you would like to return it, so we can help you resolve this as quickly as possible. Regards, The Shnoop Team ------------------------------------------------------- If that is their final response --- I'll eat my loss & never do business with them again. |

No way. I believe to ask for refund is a reasonable request! I have requested a dispute with my CC. I encourage everyone to take at least this step. If they advertised it's a refurbished, do you think how many people will jump on this? N-O-N-E! Newegg had the same player refurbished for 29.99 free shipping for a long time! |

dispute with cc is to give them pressure to stop their bad practice. If you don't do anything, they will do this again. I didn't know it's a refurbished player (without warranty) until I read the discussion here. What about those folks purchased the mp3 player and did not go online? |

What i would do is either try to get some credit from them or just send back the goods and move on what you are about to do is simply border line "legal" crime also learn from other peoples mistake that "making" money not "strait" will not take you for a long ride |

I paid for a new Sansa Fuze and received a refurbished one with no warranty. I reported that to American Express by initiating a dispute. Their dispute resolution department will collect all relevant information from me as well as from the merchant and then will decide what is fair to both parties. It's essentially third-party arbitration. These outfits like Shnoop don't give a rat's ass about me no matter how many times I email them. AMEX has much greater negotiating power with Shnoop than I do. It's one of the benefits AMEX offers their members. That is the very reason I use a credit card online, and specifically why I carry an American Express. It's not "border line 'legal' crime" in any way. |

According to various "bargain hunting" forums, Shnoop is now offering partial refunds rather than store credit. More people are discovering by accident that they received a refurbished unit. I think most people who ordered still have no idea they got ripped off, because Shnoop isn't willing to email them and inform them of the situation. When they didn't know these units were refurbs, it was a mistake. Now that they do know, letting customers go on believing they're genuine is fraud. |

The problem is that Shnoop is not being pro-active about addressing this issue. They are basically hoping that people don't notice that these are refurbished units (the small R on the back of the unit is faint and not that easy to see, other refurbished Sandisk players I've seen have a refurbished indicator that's much more visible) and keeping quiet about it. Maybe they originally made an honest mistake in thinking they were selling new units. If so, as soon as they found out about the mistake, they should have notified everyone who ordered about it and either offer to cancel the order or if it was already sent out, offer a full refund with a prepaid label to mail it back or some other form of redress. Instead, they are only addressing people who are contacting them about it and hoping that others don't find out about this issue or find out too late when they can't return it anymore. I think filing a credit card or paypal dispute is absolutely a legitimate tactic for consumers in this situation to seek redress. Notice how their response to people who've contacted them has evolved as to how they will address the issue. First, they say they will offer a refund if you mail it back to them (at your cost). Then they say to some that they will cover the return shipping cost. They they say they will also offer a 20% store credit. How is one to know what their final response will be and how long that will take? As soon as I found out these were refurbished, I decided to file a dispute to get the ball rolling on that since it does take some time for the credit card company to investigate and for one to mail back any requested forms or documentation to them. Fortunately, the web is a great forum to distribute information like this and get more people aware of what happened. I already convinced someone not to buy the stroller that they're currently advertising as new, pointing them to what happened with this fiasco. Mailing back a refurbished fuze is relatively simple, but trying to mail back a refurbished stroller would be much more difficult. |

candsave said:i see that shnoop is looking to solve the problem (send it back at there cost) Only a relative few of us hang out in these forums and have even realized we got screwed. Most of their customers will probably never discover they were sent a refurb with no warranty, and Shnoop seems all too happy to keep those customers' money and hope they never find out. Honestly, that is the most shocking aspect of this entire fiasco in my opinion. I don't understand how anyone here can think Shnoop has "done the right thing" when they're only doing it for the customers who catch them. What's right is informing ALL of their customers that the product is not new and giving them the partial refund of a full return. Everybody deserves to be treated fairly in this deal. |

Schnoop supposedly emailed someone that 20% is gonna credited back to Paypal account. Then another email about crediting back to the person's Credit Card (which they used -- not the paypal account). Interesting --- although I e-mailed them back & forth yesterday & early this morning -- I have not seen any offer to credit back 20% to my PayPal account (which I used as payment). Do I have to hound them further?
Not happy with only 20% --- still think it should be $15 -- but an account adjustment is better than their lame store credit offer. Although this would get them off the hook rather cheap. |

I don't care how much they credit back, I am not emailing them and I'm just letting AMEX handle it. |

Doesn't Rockbox break DRM permanently, even if you revert to the original Fuze firmware? yes yes, that is correct. Rockbox does break DRM. important to point that out for anyone interested. i prefer to think of it as the player ignoring evil lol no but seriously....not an issue for me....it may be for many others and yeah i understand your frustration and your point. and the anger of others. i just thought i'd post some suggestions to help a few perhaps make the most of a bad situation also i see you posted about a 20% "refund" but all i was able to find about that was this: Once again, please accept our sincerest apologies for this mishap, as well as any inconvenience this may have caused you. At this time, the only redress we can offer you is to send it back at our expense for a full, unconditional refund. Alternatively, we can offer you a 20% partial refund in the form of a store credit in lieu of sending the MP3 player back.
