Plaintiffs in the above consolidated action have brought class action lawsuits on behalf of themselves and others who have purchased Nutella at any time from January 1, 2008 to February 3, 2012, alleging that Defendant Ferrero U.S.A., Inc. (“Ferrero”) made representations through its marketing and advertising of Nutella® brand hazelnut spread (“Nutella”), improperly suggesting that Nutella is healthier than it actually is. Ferrero has denied the allegations and continues to stand by its products and advertising.

Mental note: purchase marbles painted like eyeballs, also purchase motorized bingo basket, use this to build a machine that allows me to roll my eyes at the press of a button.


For now, I'll have to do it the old fashioned way. ::rolls eyes::

Nutella is comprised of calorie-dense ingredients, such as hazelnuts and chocolate, so the spread s naturally high in calories. The hazelnuts are an excellent source of heart-healthy polyunsaturated and monounsaturated fats. Dr. Nick says the high calorie density is great for all those dangerously underweight Americans.


For what it's worth, the two main ingredients are sugar and palm oil.

I chuckled a little bit when I read that.


I am upset that it doesn't taste as good as they make it out to be. My kids and I did not like it at all. I threw it away.

The formulation they use in Europe is better. Seems to be a conspiracy to make a lot of products taste mediocre in the US so that consumers can eat an infinite amount without being satisfied. Congratulations on breaking out of the Matrix!

If the formulation is different, the taste is not significantly different. I buy Nutella once or twice a year (which is about how often I happen to pass it in the supermarket aisle without having saved enough willpower to resist) and at that consumption frequency I can't say I have noticed something off when switching from US to EU and back.
But in any case, whether it is the US or the EU version I am pretty aware I am not buying carrots so I try to refrain even though it tastes so damn good!

OT: What I guess I will never find out (no time travel) is whether m&m's tasted significantly different (better) 25 years ago or I am simply imagining it.

This lawsuit is nuts.


This is BS, pretty frivolous and opportunistic to claim this.

Calories have much less to do with it than the huge amounts of sugar dumped in the US version.

It should be mentioned, though not likely they would pursue it, but if you file a false claim you are perjuring yourself. I legitimately have bought 5 jars during that time...it is delicious stuff...though I do recall those commercials being shady when I saw them. It pretty much was "by slathering fat and sugar all over it, my kids will now eat a slice of whole wheat bread, and therefor, a healthy breakfast"

The fact that a lawsuit like this wasn't laughed out of court shows how sick our society has become. Lawyers are worse than terrorists.


People... if you think this lawsuit is sickening, don't submit a claim for jars you didn't buy. Is your integrity really worth 20 bucks?

Well the real question is if you think this is a silly lawsuit and you do eat nutella as a dessert ingredient do you submit? I love nutella, never considered it health food but I've bought more then 5 jars in the last several years.

I bought it as a household product for others/guests to consume. I like Ferrero Rocher candy, but didn't care for the Nutella and never really read the nutrition label. I assumed it was sugary and fattening since plain ol' peanut butter can pack a punch if you aren't careful with the portion size.

Then Nutella started airing a commercial about a busy mom who used it as a fast, nutritious breakfast. I think it showed her slathering it on wheat bread. A heavily edited version of the commercial still airs. I don't know that legal action was necessary, but I'm glad they modified the commercial and will gladly claim my share of the $$$.

I wish that I'd kept one of those Kobe Bryant Nutella Jars. I believe that unopened ones go for quite a bit on eBay. Amazing what kind of crap some people collect.

Gonna go out on a limb here but.... Make cupcakes with Frangelico in the batter, and top them with Nutella. Maybe whip the Nutella into a meringue if you are feeling adventurous.

Not sure I follow. If someone doesn't submit a claim, does it in any way cost the company more, or earn the lawyer less? My understanding is no. The company's agreed payout is the same no matter how many people file a claim. Same for the lawyer. If anything, more claims might mean less for the lawyers as there is more expense of tracking/contacting the individuals, but even that I don't believe is the case (their fees are paid by the fund, aren't they?).

Unfortunately , class actions aren't dictated by the law of supply and demand. As long as they make lawyers money, they will continue to file them. In order to do so, they only need a few people to act as the representative members. When those positions carry a fairly decent payout for little to no work, good luck getting everyone in the country to stonewall the class action lawyers.

Not exactly but not far off
Normal chocolate cupcake batter subtract 1/8th cup oil add 1/8th cup nutella. Bake when cooled take wooden toothpick and poke lots of holes in top. Melt 1/3 cup nutella in double burner and then remove from heat and wisk in 1/3 cup frangelico baste tops of cupcakes with this mixture. Allow to dry while making frosting Frosting is (2 sticks butter whipped with 2 cups confectionary sugar+ 1 cup coco powder+ 2 tablespoons frangellico

Hilarious. I'm a big fan of Nutella eaten plain, just not as a spread. In South America where I grew up we had a different version called "Nucita" that came in collectible glass mugs which my brothers and I pleaded to be allowed to eat all in one sitting with spoons. I am not proud to say that when I graduated my mom had a couple 12 piece sets of those mugs. ha ha
