I think most banks in the terms of service say they will give you 30 days for payment. There is a previous case that American Express lost : AMEX credit card contract gives it the right to terminate your account at any time for any reason without notice, but the court ruled that "without notice" does not mean "without given the card holder any notice", rather it means AMEX can call the cardholder on the phone and tell him "we are giving you notice that we are terminating your account effective immediately". In that case, since AMEX failed to do so, they were liable for any incidental damages caused by failure to give notice (in this case card holder was left stuck in a restaurant without any means to pay). I suspect a similar reasoning would hold BOA liable for any bounced check and other fees you incurred as a result of them closing your account without giving you any notice, plus quite possibly, interest for the time they held your money after closing the account. |

I give free dictionary lessons.
You'll notice that the dictionary you cite, Webster's New Millennium Dictionary from dictionary.com, is the same one fooled by the pseudo-word esquivalience. If proport is a real word, a similar definition should be found in at least one other dictionary. When a word is found in only a single dictionary, something is amiss.the only thing amiss is your knowledge of the English language. |

Well I put a lot of money through my accounts this past week and guess what... when I try and transfer money out of my account I get an error message saying "YOUR ACCOUNT IS LOCKED." Great. Apparently I made a transfer from my checking, it came out of my checking... and a week later it came back in to my checking and my ACH push privileges have been "locked". Nobody knows anything or has any information for me. Yay. |

Or if you don't we know that either: 1) You were deported for your terrorist activites (to Gitmo) 2) You hired a lawyer who said stop talking about this, get a mod to delete it incase BoA sees it 3) You should write books, because this was a great fiction! 4) You are a bad FWF member Post an update! |

Its funny when I see kids fighting, I tell them, come on quit it, grow up guys, and then we see grown ups bickering over trivial matters like these. Please take your fights elsewhere or start a seperate thread and keep it all there. |

http://en.wikipedia.org/wiki/Expedited_Funds_Availability_Act
My favorite section: enforcement!
Under the act, enforcement is divided by the type of institution, respective to each type's mandated oversight authority:
* For national banks, and federal branches and agencies of foreign banks, the act is enforced by the Office of the Comptroller of the Currency; * For members of the Federal Reserve System who are not national banks, and for offices, branches, and agencies of foreign banks located in the United States (who are not federal branches and agencies of foreign banks), the provisions are enforced by the Board of Governors of the Federal Reserve; * In the case of banks insured by the Federal Deposit Insurance Corporation who are not members of the Federal Reserve System, and insured state branches of foreign banks, enforcement falls to the Board of Directors of the FDIC; * The Director of the Office of Thrift Supervision is responsible for enforcing the provisions of the act in the case of savings associations whose deposits are insured by the FDIC; * Federal credit unions or credit unions insured by the National Credit Union Share Insurance Fund are subject to enforcement of the act by the National Credit Union Administration Board.
Awards for damages are limited under the regulation, including not more than $1000 in addition to actual damages for individual actions, and not more than the lesser of $500,000 or 1% of the net worth of the bank, in addition to actual damages, for class actions. |

JJDD said:At least, OP should let us know that he found a lawyer and he had to shup his mouth shut.No. He should do EXACTLY as his lawyer says whatever his lawyer says, and if that means not telling his anonymous friends he has a lawyer that that's the way it has to be. Of course, he might have met with his lawyer, asked the lawyer to protect his terrorist funds, been threatened with going to the police and then murdered his lawyer in a fit of rage and now he's on the lamb, perhaps in Jamaica and perhaps in Pakistan, while the heat cools off and he can then restart his plans to do whatever it was he was caught doing by BoA. You, dear reader, will have to be the judge. |
