How to Report Fake Company and Get the Criminal Prosecuted? Archived From: Finance

Hi all,
I think this thread belongs to Finance forum because it involves scam of money by providing fake service.

I just found that a person created a website for his fake company by using someone else's corporation name, this person may be in the process of scamming other people's money by providing fake service. How can I report him/her without alerting this person? I am afraid that the government agency won't do anything, and this criminal will just delete his/her website and destroy the evidence once this person finds that he/she is being investigated.

How can I make sure that this person will be prosecuted?

I don't think it's a good idea to post the website here. I am afraid that someone here may do something stupid that alerts this criminal, and causes him to delete the evidence.

If your objective is to get this person prosecuted but government agencies won't do anything, you are simply out of luck. Only the state can bring criminal charges. (There are a few states that have archaic laws allowing private prosecutions. But unless you can fund a private prosecution and actually get anyone to take you seriously, you are also out of luck there.)

You can try to persuade or embarrass a law enforcement agency into prosecuting. Have you even tried reporting this web site to a law enforcement agency? Or are you just assuming they would do nothing?
Have you tried the agency that licenses this type of business in your state? Or your state attorney general's office?

My first thought is that you are the scammer, and are trying to figure out teh chances of getting blindsided by the law.

But are you the 'someone else' who corporate name is being misused, or someone who was scammed by this setup? Aside from submitting a general complaint that will most likely get lost, you have to be an actual victim to formally press charges.

If you'd work up the gumption to post the website, you'd find there are entire web groups dedicated to "scam busting" (also called scam baiting). Post the website to one of these sites, if the group consensus decides that it is a scam, all sorts of things may happen.

Why don't you just alert the corporation whose name is being fraudulently used on this person's website? Surely the corporation will pursue for trademark infringement, copyright infringement, whatever legal proceedings are justified.

You do realize that even if they attempt to "delete the evidence" that there are still copies of the original page floating around? Google cache has a ton of archived pages taken at different dates.
