Any advantages of Land Trust over Living Trust for titling a property? Archived From: Finance

I have read some posts of MaxMojo who recommends Land trust or THT.

But why would a person use a Land Trust (or THT) over Living Trust when both does the same thing? I couldn't find much information online and even FWF about the difference. Can anyone clarify?

Land trusts are generally for conservancy. They are used to keep gardens, parks, wetlands, old growth forests, etc, from being developed, but can also be used to keep family lands together. It is generally a long-term caretaker arrangement.

Living trusts generally are utilized as a probate avoidance and estate planning tool, but can be used as a mild asset protection tool.

A "living trust" is any trust that's created during the grantor's life (rather than in their will). A "land trust" is any trust that holds land. If you transfer land to a trust any time other than upon your death, your trust is a land trust and a living trust.

Are we talking about something more substantive here?

Of course.

That's what "probate avoidance and estate planning tool" means. You can transfer anything into a living trust that has an ownership document, like real estate, vehicles, securities, financial accounts, etc. You can make reference to other items, but there is no manner to transfer them into a trust.

Ok. If I understand correctly you can have one or more land trusts or other asset titles or ownership documents referred under one living trust for the entire family or person.
