It will take him at least a month or two to go through the eviction process, more than enough for you to find out what the situation is. Then, you can choose to move, or stay with the new owner... . You can even get the cash for key money.People keep focusing on how long it might take someone to get evicted and, in the process, keep ignoring other issues. Please understand that depending on the state and on the terms of the lease, simply allowing the landlord to initiate the eviction process could subject the defaulting tenant (the OP in this case) to VERY substantial fines, dispossessory warrant fees, statutory or actual attorneys' fees, administrative costs, court costs, etc... Further, this could cause tremendous damage to the OP's credit history, which could cost him tens of thousands of dollars down the road, make it very difficult and expensive to rent another place, etc...

Once again, as a legal as well as practical matter the landlord's difficulties with his lender are NOT a defense to the tenant's obligation to pay rent. Hence, the OP's rather appropriate and understandable concerns about his security deposit do not, however, allow him to withhold rent. I have already posted the only strategy that can be responsibly recommended to the OP under the circumstances.

Call or e-mail them. Looks like they've helped people in similar situations. I live in Chicago also, all I can say is good luck!

If he is losing the property in a week, he would not take the time to evict you, nor would he because you have until the 4th to legally pay rent (put in place incase there is a holiday or weekend or both). I would wait until the last minute. Plus if he is losing it, you are not likely to get the SD back at all, meaning you just paid Nov. rent with that, or at least whatever part of it you are able to stay.

Like everyone else is saying, find out what exactly is going on.

Actually by law in most states rent is due the first but not late till the 10th and in some states rent is not late till the 15th. Just like a mortgage payment rent has a grace period where the landlord can not charge a late fee durning.

The landlord (or the landlord working on behalf of the bank)is having the parking lot paved before the snow hits. Last year a tenant slipped on the slippery gravel and snow and I assured the landlord he would be seeing lawsuits from tenants this year if anyone slipped.

At this point if he was losing the building I don't see why he would even bother to get this done, I'm thinking that he has already lost the building and the bank is paying him to finish off the parking lot. Once the lot is complete I will talk to him to get more info before I talk to the bank on Friday.

Tell your landlord that your Nigerian uncle was recently awarded a $56 million estate from the liquidated assets of their king. Your uncle has offered to pay your remaining rent in full, up front for the remaining lease! To speed things up, your uncle will just transfer $50K to the landlord, and the landlord will in return, refund the difference.
