Well now I got one of those weird questions, but seriously

A friend of mine had her plastic surgery in the UK that didn't work out so well, actually it was more like an injection. (yes it was cheaper than a domestic one) Tried cc dispute but after 5 months it was rejected by cc issuer. So is it hard to sue in UK? Is anyone know the legal system, or online resources to find out more about dealing with small claims in UK? The cost is under 2K USD.

Other doctors have written evaluations which confim that it was a poor job.



We need pictures to determine if it was a poor job.

Going *TO* the UK for any medical procedure, unless you are going to a couple of the top private hospitals like the foreign sheiks and dictators do, sounds pretty far-fetched and ill-advised. Did she do much research at all?

With the common language and so on, it should be pretty easy for you and her to research on the internet what it takes to sue in the UK, if you can sue for medical mishaps, etc.

They don't have as many accident/injury lawyers there who work on a no-win/no-fee basis as we do in the US, but this area has gotten a lot bigger there in recent years.

Medical malpractice is also a much smaller area because much of their medical care is government-provided, and most people there have nowhere near the high expectations for service and quality that Americans tend to have. There seem to be caps on awards, which tend to be a lot lower than American payouts.

There are many law firms that have lawyers who are qualified to practice and advise in both countries (US/UK), if that's an issue.

Sorry to be cynical, but Germany is still letting a doctor practice who was convicted of negligently killing patients in the UK, so good luck with European Union medical rulings. He is a plastic surgeon. source: http://news.bbc.co.uk/2/hi/health/8497911.stm

Also the person can change the billing address so it's within the same state or 100 miles of the transaction and dispute the charge under the Special Rule For Credit Card Purchases again, but I don't know if it applies to addresses outside the US. OTOH if the charge was made over the Internet, by phone, or by mail from the customer's address, then the transaction is covered by the Special Rule.

But the most important thing about elective surgery is to choose a good doctor. How did your friend choose the doctor?


In the past UK had a loser pays both legal bills tradition. I wonder if it still exists. Probably too fair to survive.

How much were the credit card charges?

You can sue the credit card company that refused the chargeback in your local, US court. Check with the National Association of Consumer Advocates website to find a local lawyer who knows something about this stuff. http://naca.net/
