You should be able to, unless RS places their own restriction on the device's sale. When I bought my VM Optimus from RS last year, I waited over a week before buying a service card.
Edit: Over on Howard Forums, people are claiming that if you have an existing $25/month VM plan, you can switch to the Optimus Elite and not get bumped up to $35/month, provided you do it before May 27th. YMMV.
Here's a comparison of specs for the Optimus V, Slider, and the new Elite.

The only two Optimus phones that you are allowed on the 25$ plan are the V and the Slider. This new Elite phone will bump you up to 35$ come May 27th.
This phone is $149 on the Vm site w a $35 account bonus. new customers only.
If you're planning to activate for a Vm plan that's a better deal, no? Did I miss something?
I'm considering switching to VM @ the $35/month prepaid level. Can I stack the RS coupon and the VM account bonus? No stacking...I read the terms on the VM $35 bonus, have to buy from them.
That would make this fairly warm....The Elite is still a fairly basic starter phone...IMO
How do you get the $25 google wallet discount?

I have been on the $25 plan with VM for a while and am using the rumor touch. Still debating if I should buy the Optimus. I don't like rumor touch as i always have trouble with yahoo mail that it loses connection saying my settings are wrong, and i have to clear it up and re-put in all settings. More importantly, it slows like hell. For optimus, any one has any experience? Will it be better? If i switch after 5/27, will the monthly fee really be increased? Your help is greatly appreciated.

I have the Optimus V for $25/mo. I like it because I have hotspot app which is no additional charge and it works well enough for email, usual web searching, etc.. (I mean I tap into the interent with my computer or ipod through my Optimus V phone wirelessly). Not as good for streaming, but I don't need it for that. Used with a VOIP app and I have much more than the given 300 talk minutes.
It's no Iphone. But then I don't need all the functions of an IPhone.

You can't even begin to compare the Rumor Touch to the Optimus. It's an Android phone so that will open up the whole world of apps for you as well as GPS navigation. I don't use Yahoo e-mail but there's probably an app just for their e-mail. It's my understanding that you can switch after 5/27 and can stay on the grandfathered plan as long as you don't get a phone released after May 1st. The Rumor Touch has a slide out keyboard and if that's important for you, then look for an Optimus Slider.

According to some threads on Howard Forums, you can not run tethering apps or use Quick Settings to run a hot spot. People are saying to not even try, you'll get some errors and it will shut down 3G with a full factory reset being the only method to get your phone working again.
If the Hot Spot is important, keep the Optimus.

Wow. Thanks for the answer!! I'll keep my old Optimus V. Do you think there will likely be an APP to bypass the Elite settings to get tethering to work?? Or is it a hardward thing that is unique to the Elite which stops a tethering APP from working??
Optimus Elite without tethering is such a bummer !!

Optimus Elite without tethering is such a bummer !!
You can always USB tether with an app like Klink. But if you like tethering to devices that need Wi-Fi to connect to the web (tablets, etc), stick with Optimus V. It is doubtful Virgin Mobile will ever close that loophole, especially now that there's throttling.

If you are comfortable with doing such things, you can upgrade the ROM on the Optimus V (link to forum below). IMO this makes it one of the best deals around.
