I was successful at the Lynnwood store on Friday, but it took some work. Here's my story:
I took the drive up the cashier and as she started to ring it up I took out the Fry's ad and said I'd like a PM. She looked at the ad for a bit and said that she would have to charge me $170 but then I would get a $90 gift card to use in the store. I countered by saying Frys doesn't do that, they take the price off the product at the time of purchase... but I wasn't 100% sure so I didn't continue the argument. She insisted that the best she could do is give me a gift card for $90 so I said no thanks and walked out.
When I got in my car, I called Frys and asked them what "instant gift" meant, and they said there's no gift card, you get the price off at the register and pay $79.99+tax.
So I went back in the store and walked back up to the same cashier and explained I had just called Frys and verified there's no "gift card" and the drive is $79.99+tax OTD. So she called over some assistant manager, and he looked at the ad for a bit and then instructed the cashier to call Frys and verify my story and verify stock.
She got off the phone and chuckled to the manager saying, "Yup, it's $79.99+tax OTD and they have 'em in stock". Then they both turned away and talked for a second. She came back to me and said, "OK, we can do it."
Now here's the funny part. As I was signing my receipt, I noticed out of the corner of my eye that she was quickly grabbing the rebates that were printing out and tossing them under the counter. I thought about telling her I know what she's doing and that I can just print them off of their website... but I thought it would be better to let them think they "won".
BTW, the receipt doesn't say anything about a PM, so I don't think I'll have any issues getting the rebates. |

To make the deal even sweeter, they pricematched the 16mb buffer to the 8mb buffer hard drive. (the 16mb one is 10$ more expensive.), ended up with 20$ after rebates

yep, that was me in front of you, i decided to go back and get another one today. there was a different manager working today though, so when the CSR went back to check with him, he told her to ring it up as 79.99 + 60 to account for the rebates. when i told her that yesterday i was able to receive the full PM, she called him up to the desk, and he said he couldn't sell it to me for $79.99 because that would be below his cost. luckily though, i had my receipt from yesterday, so i showed him, and after he went in the back to talk to someone else, he agreed to do it.
glad at least one of you was able to get in on it! and thanks again OP, what a deal!!!

I would have been happy with the gift card. You really were pushing your luck. |

It's no big deal. To get my PM at CUSA I also had to purchase a gift card for $90 to make up the difference between their price and Fry's. I immediately cashed it in, right then and there. You're not taxed on the GC so the only extra bother is a few minutes of time. |

My Mileage Varied and since Fry's is a 45 mile round trip drive -- I saved $5 in gas and just as important 1 hr of time.
So yeah -- not perfect --- but good enough. And now I have a hall pass to buy something else at CUSA 
all a matter of perspective -- could I have argued -- maybe -- but wasn't worth the time or effort to do so.

I think you didn't understand what the rule said. It just said the consumer may be deceived. And in next one, it said...
(c) Accordingly, whenever a ``free,'' ``2-for-1,'' ``half price sale,'' ``1 sale,'' ``50% off'' or similar type of offer is made, all the terms and conditions of the offer should be made clear at the outset. [Guide IV]
So didn't say it is illegal to do but need to make the deal clear. But remember in your case, you are the one asking for the PM and they are giving you an counter offer. And clearly you understand what their offer is when the deal was made. |

And in the same link from FTC, it has
(a) Frequently, advertisers choose to offer bargains in the form of additional merchandise to be given a customer on the condition that he purchase a particular article at the price usually offered by the advertiser. ... ... It is important, therefore, that where such a form of offer is used, care be taken not to mislead the consumer.
There is nothing wrong as indicated by you and by FTC that the store can offer something with strings attached as long as care be taken not to mislead the consumer. And in this case, everyone clearly understand that they will lower the price of the first item for seningen if he buy the gift card. And no one is deceived. So just the first point(offer with string attached) doesn't make this deceptive trade. Actually the FTC guide show this is NOT really deceptive trade since no one is actually deceived because it is VERY CLEAR to everyone what is going on and what the offer is. |

Fry's has the 300GB PATA on sale again for $100 OTD. The price is good today and tomorrow. The item number, 4596277, is for the 16MB buffer version, not the 8MB. I don't know if the 8MB will also be on sale. The good news is that the printed Fry's ad doesn't mention the buffer size, so you should be able to pull off the PM with either.

I would have been happy with the gift card. You really were pushing your luck.
Not to mention that a CC gift card is as good as cash.
All you need to do is buy something online with the GC plus some amount on a credit card, and then cancel the order before picking up. The entire purchase amount will be credited to your CC. |
