No, after going to check out, you can remove the $25 air time.

Got one, thanks op For a while, AT&T was charging back the $85 "Discount" on your credit card if you didn't activate the phone, but I don't see that anywhere listed anymore. In for one...

Doesn't mean you have to use the plan. If you don't buy/add airtime all you have left is a phone to do with as you please.

Without the air time, can you activate the phone? If you can't, will there be a penalty charge from AT&T. TIA

Just add the per usage plan. (The one that charges you $.25 a minute one.)
You must add a plan to place the order.
