I can't speak for brother lasers, but every inkjet i've gotten has had new inks in it. While printer companies charge a lot for their ink, it doesn't cost them that much, they aren't going to mess around intentionally with putting in used, partly empty ink, since that would tick off the customers and make more service calls for them.
Brother ink jets come with the same size ink whether they are new or refurb. They don't play games like HP does with "high capacity" ink carts that they fill fuller. Which isn't to say that brother carts are completely full, just that you don't have the range of options that companies like HP do with all their ink cartridge options that seem designed to confuse the consumer.
I've never heard of a refurb printer coming with a used ink or toner cartridge in it. Many do come with "starter" cartridges which print fewer pages than an off-the-shelf cartridge.
