Let the flaming begin....I'm probably the only human left on earth who hasn't played either of these.... If you don't already have instruments/controllers, look at the song lists and choose the title offering the most music you'd be interested in.
Guitar Hero by far - better game structure + design choices and ergonomics better thought out=more refined product as a result. It also has massive support in DLC so you never get tired of the game. Just a very fun game
Rock Band is a good first effort but simple things such as menu/GUI design as well as the game narrative leaves you frustrated.

I'm not sure where you're seeing Guitar Hero having superior DLC, but Rock Band absolutely blows away Guitar Hero in this department. Just take a look at the song list on wikipedia for Guitar Hero and Rock Band. Speaking as someone who bought Guitar Hero World Tour at launch, I had a lot more fun playing my friends copy of Rock Band 2 and actually wish I had bought Rock Band instead at that time.
Now if you're comparing instruments, I do prefer Guitar Hero instruments over Rock Band, but Guitar Hero instruments are compatible with Rock Band. For the best of both worlds, buy Guitar Hero instruments and get the Rock Band software.

I actually feel the exact opposite, especially in terms of refinement. I own almost all the games from both franchises but Rock Band 2 is the only game that consistently gets played because it's simpler but more fun. Song charts are easier to make out, drum fills actually make sense, and the game just feels less cluttered overall. I have no problems with the UI design and I think it's actually well done. The simplicity in it allows you to easily find what you want.
In terms of DLC I think there's no contest -- RB has it won hands down. I can count on one hand how many songs I've downloaded for GH, but for RB I lost count a long time ago. The availability of DLC makes a huge difference in my opinion, unless you're someone who doesn't mind playing only the on disc songs. I think of it more as buying into a platform in the long run, as DLC has and will continue to be a substantial amount of the song base looking forward.
Rock Band is far from a first effort. The Rock Band series was developed by Harmonix, who originally created the Guitar Hero series. Harmonix split from Activision after GH2 and went on to create the Rock Band series, while Activision bought up Neversoft to develop GH3 and subsequent GH games. So if anything, the GH series actually has less music-game development experience behind it and IMHO it shows.
Given my preference for RB2, I still generally tell people to buy whichever has the more appealing songs, although DLC should be taken into account if one is willing to pay for them. My friends and I are the type who play every instrument on expert and try to 100% every song, and I'm aware that a lot of this stuff doesn't really matter as much to people who aren't quite as serious about these games. During parties with more casual players, games from both franchises get play time.

Yes. I have 2 GH guitars, rockband drums and American idol mic and they all work between all of the games. The only system I have heard of with problems was the Wii, but I know ps3 and 360 work
