I don't believe that the seller's eBay status affects the timeline for filing disputes/claims with paypal. The seller could be NARU for something as innocuous as failure to pay eBay fees or old contact info, and could well be reinstated within a day or two. If you are certain that the seller has been NARUd for something serious, and the PP system will not let you file online, you may be able to call and have them open a dispute/claim for you over the phone.

Ive been screwed by buyers who just sent an item back if unhappy, even if the auction tersm clearly stated all sales final/no refunds. Paypal seems to side with buyers if they provide return tracking information, regardless of auction terms.

Has any seller been able to keep their Paypal money if buyer disputed an as is item and sent it back w.o authorization

I have heard a few cases of sellers keeping money despite returns. It happens most often when the buyer does not obtain proof of delivery to the seller (DC/tracking, and sig when appropriate). It can also happen if/when buyers return items damaged/switched and the seller notifies PP about the problem as well as obtaining required documentation regarding it (such as a police report).

By repercussions as a buyer, what do you mean? The seller can neg you, and can file an unpaid item dispute, but you do have recourse against both of those.

The NPS alert generally results in a wrist-slap, unless there's a pattern of NPS alerts against a seller. eBay's new bad-seller cleanup is taking into account recent NPS and neg/neutral fb, so if the seller makes a habit of flaking out, he'll likely be feeling eBay's wrath before long.

Thanks for all the info tlaxson. I thought I was on the right track with the 'proper' way to express my displeasure with a seller who decided that the item I'd won sold for too little, and your post here confirmed it.

tlaxson, I have one for you. Let say I bought 10 items from a seller and he only shipped 5 and said he would ship the other 5 later on. A month goes by, nothing....would this by a INR or SNAD?

How many payments? Are you using paypal?

One payment for all 10 items? SNAD. One payment for what you received, and one payment for what you did not? INR.

I bought a phone from a seller on Amazon. Fedex shows it was delivered/left at front door, no signature required. The item cost me $60. I have been at home all day during that time period and never saw fedex, and never received the phone. Do I have any recourse? If I file a dispute with my CC will they honor it, even though it says delivered? I have contacted the seller and they said since it shows delivered the only thing to do would be file a claim with fedex.

Acura, PayPal considers that SNAD. If you filed INR, the seller presumably can refute it with tracking, so SNAD is the most appropriate option given the circumstances you describe.

Thanks, that's what I thought but I wanted to check with you first. To top it off, this guy didn't even use proof of signaure as all 10 items total price was over $400.

just a quick update, I facilitated the issue and gleaned some valuable knowledge in the process while talking with the fedex rep. The fedex claim information is the most interesting. I didn't realize the option for the $250 guarantee, and the $50 AMEX gift card from fedex was a nice little extra, didn't realize they were doing that. thanks for everyone's help!

just a qucik update - recieved my $50 AMEX gift card yesterday from fedex. not too shabby

anyone have experience double dipping the AMEX gc?

I'm really surprised they run this promo, they have to be losing money on that.

UPDATE: on a whim I decided to "apply" for the $50 AMEX gift card 4 more times. they all came in the mail today. I can see the potential for abuse on this....

I have won an item on eBay from a power seller and then paid with paypal. The next day I find an email from the seller saying that he stated in his listing that he does not accept paypal and that if I want to use paypal I should have contacted him before bidding. Then he says that in order for him to accept my paypal payment he is gonna charge me an extra $20 and he did refund my initial payment and send an invoice for the new amount. I told him that he cant surcharge for paypal and he was like I am a power seller I have been on eBay since it started and you have agreed to the terms when you made a bid. I know that is is wrong and I did file a non-selling seller complaint but nothing much happened. Now I am not gonna pay for that item and I just want to get out of the situation and avoid any strike or negative feedback. I have emailed eBay cs with no response. What do you suggest?

Just ignore it and buy the item from someone else.

If he files an UID just reply back saying that you paid.
