I listed a new Sony digital camera on eBay and it was cancelled by eBay with the following message:

"MC019 eBay Listing Removed: Trademark Violation - Unauthorized Listing Content

The listing was removed because it violated eBay policy.


The rights owner or an agent authorized to act on behalf of the rights owner, Sony Electronics, Inc., notified eBay that this listing violates intellectual property rights. When eBay receives a report of this type of violation, we remove the listing to comply with the law."

I really dont have any clue why?

I mentioned "1 Year Sony Warranty". Is that the issue?. The camera carries 1 year warranty. Is it void when i sell?


Update: You are right. Warranty claim is the issue. I have to remove the warranty claim and list i guess.


The warranty is for the original owner. Since you own it, that would be you. Once you sell it, warrenty is void, as the buyer is not the original owner. So yes, that's what caused the issue with eBay.

Its rediculous how Sony (and other companies) can claim trademark infringement just for stating the unit has a warranty.

I'm not saying that its right to state it in the auctions if it truly is invalid, just that the manufacturers go ahead abusing the DMCA like this calling a wrong statement a trademark violation.

(Of course, the best is Mcafee who claims trademark infringement for selling an item with the UPC cut off...lol)


Representing manufacturers warranties is pretty risky and opens you up to SNADs.

Warranties often apply for purchases from authorized resellers and are often not transerable.

In the future you'd be better off stating the following:

"Item is new but please check with the manufacturer regarding warranty coverage."


Sony isn't being "ridiculous" at all about this. No company that I know of allows for warranty transfers, since they allow for tons of scamming and "lost" receipts. So it's false advertising of sorts to say an eBay item comes with a warranty if its being resold. And it also hurts the business of Sony's authorized resellers who's items indeed come with warranties.

I suppose in theory you could sell it "under the table" with a warranty by shipping it incl. your original receipt.


When selling a newer item, I usually just say that I will include a copy of the sales receipt. Whether people want to interpret that as my way of proving the item is almost new or a possible opportunity to be covered under warranty is up to them.

The issue here is that big companies like Sony want you to buy their products new so they make the profit. Claiming copyright infringment is the easiest way to eliminate competition from the "used" market.
I can see if you are using their pictures or promotional copy from their webiste, but sheesh, some of companies are ridiculous... especially @pple and Micro$oft!

Only thing I don't like about that is you are exposing where you bought the item and how much you paid. Not a problem if you are selling it just to get rid of it but if you're selling for profit, I would think most buyers might be upset to see how much you actually paid for the item opening you up to more disputes and low DSR's.

Only thing I don't like about that is you are exposing where you bought the item and how much you paid. I always get a gift receipt and state it in the ad that I will send that with. I can't stop them from drawing their own conclusions then AND it not directly listed with the price. If they try to return it & find out it was bought for less, hopefully they already have left the feedback by then & then they might open themselves up to some sort of claim of deception.


My Sony camera listing is also removed today. I did not mention warranty at all. But I think I use an image from Google and probably only two copied sentences. Great job, Sony!

You should probably plan to keep the camera so you can capture your own images


About a month and a half ago I had two different Sony cameras listed in eGay, and simultaneously on Amazoo. Both cameras sold on Amazoo for about $15-$25 more than the BIN price with free shipping I had on eGay, so I happily closed the eGay listings. About a week later, I received takedown notices from eGay. I've sold many Sony cameras before on eGay, and never had a problem. Looks like Sony are desperate to sell their shitty cameras through retail channels only.


I had two of my Sony camera listings taken down three times.
- Once it was indeed due to the pictures (wish I came across this post earlier).
- The second time around it was due to the warranty sentence which I removed completely only levaing that the item is brand new and sealed
- The third time I received a notice that the listing is taken down after all the cameras are sold.

In neither of 3 cases i had a reason listed in the email. All the time I had to give them a call so that the representative could enlighten me. On my third contact with e8ay I was told that it was due to teh copyright infringement (whatever the hell this means).

On a different ocasion I had 2 open boxes listings with Adobe Photoshop taken down. The software was completely legal and purchased from a liquidator. The listings were taken almost immediately, again, with no explanation. I checked the part numbers - the softares were totally retail version, I listed tham as used with no implied guarantees... I think e8ay VeRo program is totally screwed up and was solely intended to help e8ay covering their asses.

Every company manufacturer can find out 1000 reasons why your e8ay listing infringes a copyright and frivolously request e8ay to take your listing down. They don't even required to explain why if the they invoke a Copyright Infringement clause.


A note that eBay takes copyright infringement claims from different companies differently. When I complain about copyright infringement after another seller has copied my photographs, eBay just ignores me.

If you are going to steal pictures it is better to steal another seller's pictures then it is to steal Sony's.


So no warrantee if you give a camera as a gift?

eBay and Sony have repeatedly taken down my auctions featuring new Sony cameras. The second time, claiming that stating the warranty was valid was "false." I agree with the above post - does this mean when a Sony camera is given as a gift, the warranty is invalid? I'm also wondering if this is a racket between Sony and eBay, because unless I'm mistaken (and someone chime in if they know the answer) but I think eBay keeps your listing fees when they cancel your auction.
